1. Not legal or professional advice
ComplyMate is operated by Thannlab Pty Ltd. We provide POPIA self-assessment tools and educational compliance guidance only. Nothing on https://complymate.co.za constitutes legal, audit, accounting, or other professional advice.
You must consult a qualified legal or compliance professional for advice specific to your organisation, sector, and processing activities.
2. No guarantee of compliance
Our questionnaire, scoring, grades, fix recommendations, PDF reports, emails, and dashboard content are based on general POPIA themes and your self-reported answers. We do not guarantee that:
- Your organisation is compliant with POPIA or any other law
- Every compliance gap has been identified
- Recommendations are complete, current, or suitable for you
- Regulation updates or emails cover all relevant changes
You are solely responsible for assessing and implementing compliance measures in your business.
3. Trust badge and verification
A ComplyMate trust badge or public verification page reflects our independent self-assessment at a point in time. It is not approval, certification, or endorsement by the Information Regulator or any government body. You must not alter, misrepresent, or overstate what the badge means.
4. Your responsibilities
You agree that you will:
- Provide accurate information in assessments
- Not rely on ComplyMate as a substitute for professional advice
- Not present results as official legal certification
- Use paid features only while your entitlement is active
5. Third-party services
We use third-party processors including Supabase (auth and data), Paystack (payments), Brevo (email), and Vercel (hosting). Their terms and privacy practices apply to their services. We are not responsible for outages, errors, or acts of those providers beyond what South African law requires.
6. Limitation of liability
To the fullest extent permitted by the laws of the Republic of South Africa, Thannlab Pty Ltd and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential loss (including loss of profit, data, goodwill, or business opportunity) arising from use of ComplyMate.
Our total liability to you for any claim relating to the service in the twelve (12) months before the claim shall not exceed the total fees you paid to us in that period (or ZAR 0 if you used only free features), except where liability cannot be excluded by law (including rights under the Consumer Protection Act where applicable).
7. Indemnity
You agree to indemnify and hold harmless Thannlab Pty Ltd against claims, damages, and costs arising from your misuse of the service, misrepresentation of assessment results or badges, breach of our Terms of Service, or violation of law, to the extent permitted by South African law.
8. Changes and availability
We may change, suspend, or discontinue features at any time. The service is provided “as is” without warranties of uninterrupted or error-free operation.
