By using ComplyMate, you agree to these terms. Please read them carefully together with our Disclaimer and Privacy Policy.

1. Acceptance of terms
These Terms of Service are entered into between you and Thannlab Pty Ltd (ComplyMate), operator of https://complymate.co.za. By accessing the website, creating an account, or using our POPIA compliance assessment, you agree to be bound by these terms, our Privacy Policy, and our Disclaimer.
2. Eligibility
You must be at least 18 years old and using the service for lawful business purposes. If you register on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
3. Service description
ComplyMate provides an online POPIA compliance self-assessment tool for South African businesses. The free assessment gives an indicative score, grade, and category breakdown.
Full Report (R499, once-off): unlocks detailed fix recommendations, a PDF report, and a basic trust badge for the assessment purchased.
Monitor (R299/month): unlocks fixes and PDFs for all assessments while subscribed, a premium trust badge, score history, quarterly reassessment reminders, regulation update emails, and personalised compliance tips on your dashboard.
These terms apply to our website and any ComplyMate mobile applications we may offer.
4. Not legal advice; no reliance
ComplyMate provides compliance guidance and educational information only. It does not constitute legal advice. Results are not a legal certificate of compliance. You use the service at your own risk and must not rely on it as a substitute for professional advice. See our Disclaimer for full limitations.
5. Acceptable use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to reverse engineer, scrape, or disrupt the platform
- Misrepresent assessment results as official legal certification
- Display a ComplyMate trust badge when your entitlement has expired or been revoked
- Share account credentials with unauthorised parties
6. Trust badge and verification
Paid plans may include a ComplyMate trust badge and public verification page. The badge reflects our independent POPIA self-assessment only. It is not official regulatory certification. You must not alter the badge to misrepresent your score, grade, or compliance status. We may revoke badge access for misuse or expired assessments.
7. Accounts, subscriptions, and payments
Paid features require account registration. On the website, payment is processed by Paystack in South African Rand (ZAR). Monitor subscriptions renew monthly until cancelled through your account settings or by contacting hello@complymate.co.za.
ComplyMate iOS app: the iOS application does not offer in-app purchases or Paystack checkout. Plan upgrades, new subscriptions, and billing changes must be completed at https://complymate.co.za in Safari. Existing paid entitlements remain available in the app while active.
Once-off Full Report purchases are non-refundable after fixes and PDF access have been unlocked, except where required by South African consumer law. Monitor fees already paid for the current billing period are not refunded when you cancel; access continues until period end.
8. Intellectual property
All content, branding, questions, scoring methodology, and software on ComplyMate are owned by Thannlab Pty Ltd or its licensors. You may not reproduce or distribute our materials without written permission.
9. Service availability
We aim to keep ComplyMate available but do not guarantee uninterrupted access. Maintenance, third-party outages (including Supabase, Vercel, Paystack, or Brevo), or force majeure may affect the service. Features may change with reasonable notice where practicable.
10. Disclaimer of warranties
The service is provided “as is” without warranties of any kind. We do not guarantee error-free operation or that the assessment will identify every compliance gap.
11. Limitation of liability
To the fullest extent permitted by South African law, Thannlab Pty Ltd shall not be liable for indirect, incidental, special, or consequential damages arising from use of the service.
Our total liability for claims relating to the service in any twelve-month period shall not exceed the fees you paid us in that period, except where liability cannot be limited by law.
12. Indemnification
You agree to indemnify Thannlab Pty Ltd against claims and costs arising from your breach of these terms, misuse of badges or results, or violation of applicable law, to the extent permitted by South African law.
13. Governing law
These terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the exclusive jurisdiction of South African courts. POPIA-related complaints may also be directed to the Information Regulator; that does not limit your statutory rights where they cannot be waived.
14. Account termination and deletion
You may delete your account at any time from account settings. Deletion removes personal profile data, saved assessments, and active entitlements. We may retain anonymised billing records where required by tax or consumer law. See our Privacy Policy for retention details.
